EsReal Plugins and Extensions

1. Acceptance of Terms

By installing and using EsReal Plugins ("Plugins," "Service," or "Product"), you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all EsReal plugins including Outlook Add-in, Gmail Add-on, and Browser Extension. If you do not agree, do not install or use the Plugins.

2. Service Description

EsReal Plugins provide domain security and verification services:

Email Plugins (Outlook & Gmail)

Analyze sender email domains for authenticity verification
Display security indicators and trust status within email clients
Help detect phishing, spoofing, and fraudulent email activity
Provide organizational domain approval status (enterprise mode)

Browser Extension

Validate website domains for authenticity and trustworthiness
Detect potentially fraudulent or spoofed websites
Display domain verification status and security indicators
Provide trust scores and organizational information for websites

3. License Grant

Subject to compliance with these Terms, EsReal grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Plugins for personal or organizational use consistent with applicable end-user license agreements.

4. User Obligations

You agree to:

Use the Plugins only for lawful purposes and in compliance with all applicable laws
Not reverse-engineer, decompile, or attempt to access source code
Not bypass security measures or attempt unauthorized access
Not use the Plugins for phishing, spam, fraud, or malicious activities
Not use the Plugins to harass, threaten, or defame individuals or organizations
Maintain confidentiality of API keys and enterprise authentication credentials
Not redistribute, resell, license, or modify the Plugins without permission
Not use the Plugins to develop competing products or services
Comply with email platform terms (Microsoft Outlook, Google Workspace)
Comply with web browser terms (Chrome, Edge, Firefox, Safari)

5. No Warranty / Disclaimer

CRITICAL DISCLAIMER: The Plugins are provided "AS IS" without any warranties, express or implied. EsReal disclaims all warranties including merchantability, fitness for purpose, and non-infringement.

Plugins are provided without guarantee of accuracy or completeness
Domain verification results may contain errors, false positives, or false negatives
Plugins may not detect all phishing, fraud, or spoofed websites
Service may be interrupted, delayed, contain bugs, or become unavailable
Security threats, vulnerabilities, and malicious websites may not be detected
Plugin functionality may be affected by platform updates or changes

IMPORTANT: The Plugins are security tools intended to SUPPLEMENT, not REPLACE, your existing security practices. Always maintain vigilance against phishing, social engineering, fraudulent websites, and suspicious communications. Verify sensitive information through trusted channels.

6. Limitation of Liability

To the maximum extent permitted by law, EsReal shall NOT be liable for:

Indirect, incidental, consequential, special, or punitive damages
Loss of data, revenue, profits, or business opportunities
Damage from verification errors, false positives, or false negatives
Undetected phishing, fraud, spoofed websites, or security breaches
Third-party service failures (email platforms, web browsers)
Plugin crashes, corruption, data loss, or malfunction
Damage from visiting fraudulent websites despite plugin warnings
Any damage exceeding the total amount paid for the Plugin (if any)

Some jurisdictions do not allow limitation of liability. In such cases, liability is limited to the maximum extent permitted by law.

7. Acceptable Use Policy

You may not use the Plugins for:

Sending spam, phishing, scams, or malicious content
Creating fraudulent or spoofed websites or domains
Unauthorized security testing or penetration testing
Violating email platform or web browser terms
Infringing intellectual property rights
Harassment, threats, defamation, or illegal activity
Accessing others' accounts without authorization
Circumventing security controls or authentication mechanisms
Excessive API usage or resource consumption
Using the Plugins to identify targets for phishing or fraud

8. Termination of Access

EsReal may suspend or terminate your access if you:

Violate these Terms or applicable laws
Engage in malicious or abusive behavior
Abuse API resources or rate limits
Violate email platform or browser policies
Pose a security risk to EsReal infrastructure
Use the Plugins for fraud or malicious purposes

Upon termination, your license immediately ceases. Data may be retained for a limited period per our retention policy before deletion.

9. Modifications to Terms and Service

EsReal may modify these Terms and the Service at any time. Material changes will be communicated via email or in-plugin notification. Continued use after modification constitutes acceptance of new Terms.

10. Intellectual Property Rights

All Plugin content, features, functionality, code, algorithms, designs, and graphics are owned by EsReal or its licensors and are protected by copyright and intellectual property laws. You retain no ownership rights to the Plugins.

11. Third-Party Services and Dependencies

The Plugins depend on third-party services:

Email platforms (Microsoft Outlook, Google Gmail)
Web browsers and extension ecosystems (Chrome, Edge, Firefox, Safari)
EsReal's verification infrastructure

EsReal is not responsible for third-party service failures, outages, policy changes, or discontinuation.

12. Indemnification

You agree to indemnify, defend, and hold harmless EsReal, its officers, directors, employees, and agents from any claims, damages, losses, or costs (including legal fees) arising from: (a) your use of the Plugins; (b) violation of these Terms; (c) violation of applicable laws; or (d) infringement of third-party rights.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with Belgian law, without regard to its conflict of law principles. Any legal action relating to the Plugins shall be brought exclusively in the competent courts of Belgium.

14. Dispute Resolution

Before initiating legal proceedings, parties agree to attempt resolution through good faith negotiation. If negotiation fails, disputes shall be resolved through mediation or binding arbitration under Belgian law.

15. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and EsReal regarding the Plugins and supersede all prior understandings.

16. Severability

If any provision of these Terms is found invalid or unenforceable, that provision is severed while all remaining provisions remain valid and enforceable.

17. Export Compliance

The Plugins may be subject to export control regulations. You agree not to export or re-export the Plugins to prohibited countries or parties.
